These Terms & Conditions apply to all custom-decorated or made-to-order products sold by Ricart Inc through the website fleming-college-name-tags.deco-apparel.com and its affiliated brands. By placing an order, you agree to these Terms.

1. Ordering, Custom Products & Cancellations

All products are custom-made to order. Once an order is approved, it cannot be changed, cancelled, or refunded unless otherwise allowed under this policy.
Order cancellations may be requested within 24 hours of placement.
If blank goods have already been ordered from suppliers, a 15% restocking fee will apply.
Refunds for eligible cancellations will be processed within 5–7 business days to the original payment method.

2. Returns & Refunds

Because each product is custom-made, all sales are final.
If there is an issue with your order, contact us within 7 days of delivery with:
- Your order number
- Clear photos of the issue or defect
Valid claims include:
- Decoration errors differing from the approved proof
- Manufacturing defects (holes, stitching flaws, structural issues)
- Incorrect sizing compared to the posted size chart
- Shipping damage reported immediately
In such cases, Ricart Inc will, at our discretion, repair, replace, or credit the affected items.
Unauthorized returns, incorrect sizing, or minor color variations are not eligible for refund or replacement.

3. Sizing & Color Variations

Size charts are provided for all products. It is the customer’s responsibility to select the correct size (e.g., YOUTH vs. ADULT).
Refunds or replacements will not be issued for sizing errors.
Colors may vary slightly due to screen settings or fabric dye lots. Such variations are not grounds for refunds or replacements.

4. Pick-Up & Storage (Abandonment Policy)

Customers will be notified when their order is ready for local pick-up.
A second attempt to contact you will be made once your order is complete and invoiced.
Orders must be collected within [30 or 45] days (depending on store policy) from the invoice date.
If you are unable to pick up, shipping arrangements may be made once the balance is paid in full, subject to your account terms. Shipping costs are the customer’s responsibility.
Orders not collected within the stated timeframe, and where no shipping has been arranged, will be deemed abandoned. Abandoned orders are not eligible for refund, replacement, or continued storage.

5. Shipping Policy

Delivery Options: Orders may be shipped or held for local pick-up.
Shipping Costs: Customers are responsible for shipping charges unless otherwise agreed in writing.
Delivery Times: Timelines are estimates only. Ricart Inc is not responsible for courier delays, weather, or other events beyond our control.
Address Accuracy: Customers must provide accurate addresses. Orders returned due to incorrect addresses may incur re-shipping charges.
Risk of Loss: Title and risk transfer to the customer upon delivery to the carrier.

6. Replacement Policy

Eligibility: Replacements are issued for verified defects, production errors, or shipping damage.
Process: Contact info@ricarts.ca within 7 days of delivery with your order number and photos.
Resolution: Approved claims may result in repair, remake, or replacement at no charge.
Non-Eligibility: No replacements for sizing errors, normal wear, or minor color variations.
Replacement Shipping: Standard ground shipping is covered; expedited shipping is at the customer’s expense.

7. Digital Proofs

Customers must carefully review and approve digital proofs before production.
Approved proofs are considered final. Changes after approval may result in extra costs or delays.

8. Supplied Artwork & Intellectual Property

Customers are solely responsible for ensuring they have rights to all artwork, logos, or designs submitted.
Prohibited Content: We will not knowingly print unlicensed or copyrighted content (e.g., Disney, Harley-Davidson, sports teams, entertainment logos) without authorization.
Right to Refuse or Cancel: Ricart Inc may refuse or cancel orders at any stage if we believe content infringes third-party rights. Refunds for cancelled orders will exclude costs already incurred.
Indemnification: Customers agree to indemnify and hold harmless Ricart Inc for any claims, damages, or legal actions arising from unlicensed artwork provided.

9. Marketing & Social Media Use

By placing an order, you grant Ricart Inc the right to photograph or record your products for marketing, social media, website galleries, or promotional use.
This includes incidental use where artwork may appear in the background of shop photos or videos.
If you prefer not to have your designs shared, notify us in writing at the time of your order. We will make reasonable efforts to honor such requests.

10. AI-Generated Content

Customers are responsible for ensuring they have the rights to any AI-generated content submitted.
Ricart Inc does not verify authorship or copyright of AI-generated designs and will not be liable for disputes related to such content.

11. Sustainability & Environmental Claims

Environmental or sustainability claims (e.g., “eco-friendly,” “organic,” “recycled”) are based on information from suppliers.
Ricart Inc does not independently audit these claims and makes no guarantees beyond supplier documentation.

12. Force Majeure / Supplier Delays

Ricart Inc is not liable for delays or cancellations due to events outside our control, including supplier shortages, shipping disruptions, strikes, natural disasters, pandemics, or government actions.

13. Website Use & User Conduct

Customers must not use our website or services to upload or distribute unlawful, infringing, defamatory, or offensive content.
Prohibited conduct includes:
- Uploading viruses, spam, or malicious code
- Impersonating others
- Attempting to reverse-engineer or disrupt the site
- Excessive or abusive use of services that affects others
Ricart Inc may suspend or terminate accounts and refuse orders for violations of these Terms.

14. Website & Intellectual Property

All content on this website, including text, images, branding, and layout, is the property of Ricart Inc or its licensors.
You may not copy, modify, or redistribute site content without permission.
The website and services are provided “as is” and “as available,” without warranties of any kind, express or implied, except as stated in these Terms.
Ricart Inc may update, modify, or discontinue parts of the website at any time without prior notice.

15. Liability

Ricart Inc’s liability is limited strictly to the value of the affected order.
We are not responsible for indirect, incidental, or consequential damages.

16. Governing Law

These Terms are governed by the laws of Ontario, Canada, and applicable federal laws.
Any disputes shall be resolved in the courts of Ontario.
